Automatic Exchange of Tax Rulings – European Commission Publishes Proposal Amending the Directive on Administrative Cooperation
On March 18th, 2015, the European Commission has published a proposal to include an automatic exchange of tax rulings and advance pricing agreements (APAs) into the Directive on Administrative Cooperation. The proposed exchange of information concerns all future rulings and APAs (unless only natural persons are affected), as well as rulings issued in the ten year period before the implementation of the new rules, provided these rulings are still in force. Information shall be provided to all member states as well as the European Commission. Member states should agree on the proposal by the end of 2015 so that the amendments can enter into force on January 1st, 2016. Georg Gottholmseder gives a brief overview of the proposed changes.
I. Ausgangslage
Seit Juni 2013 prüft die Europäische Kommission die Vorgehensweise einzelner Mitgliedstaaten in Zusammenhang mit Tax Rulings (Auskunftsbescheiden) aus Sicht des Beihilfenrechts.
