The Revision of the Administrative Assistance Implementation Act
On May 28th, 2014, a revision of the Administrative Assistance Implementation Act (Amtshilfe-Durchführungsgesetz – ADG) passed Parliament as part of the Budget Accompaniment Act (Budgetbegleitgesetz – BBG) 2014 with a view to follow the recommendations of the Global Forum on Transparency and Exchange of Information for Tax Purposes concerning exceptions from prior notification to taxpayers on foreign requests for bank information. The legal changes also reflect recent amendments to the Austrian Constitution concerning legal procedures before tax courts and also cover the amendments approved by the OECD Council on July 17th, 2012, in respect of the OECD Commentary on Article 26 of the OECD Model Convention concerning “group requests”.
I. Allgemeine Bemerkungen
Am wurde das BBG 2014 vom Bundesrat genehmigt. Die Kundmachung erfolgte in BGBl. I Nr. 40/2014. Art. 20 dieses Bundesgesetzes sieht eine Änderung des ADG vor. Diese Änderungen beziehen sich im Wesentlichen einerseits auf die vom Global Forum on Transparency and Exchange of Information for Tax Purposes (im Folgenden: Global Forum) als Ergebnis der Phase-1-Prüfung Österreichs eingeforderten Ausnahmeregelungen von der in diesem Gesetz vorgesehenen allgeme...
