Seit dem Aktionsplan der Europäischen Kommission für nachhaltiges Finanzwesen 2018 wurde eine Flut an Regelungen - von der Offenlegungsverordnung über die Taxonomieverordnung bis hin zur aktuellen Corporate Sustainability Reporting Directive - erlassen, um privates Kapital in nachhaltige Finanzierungen umzulenken (Green Finance). Der Beitrag stellt zunächst die vor allem für Banken maßgeblichen europäischen Green-Finance-Regeln für die Kredit- und Kapitalmarktfinanzierung dar, um anschließend die Haftung und Sanktionen bei Verstößen zu beleuchten.

Since the Commission’s Action Plan on Sustainable Finance in 2018, a flood of directives and regulations - from the Sustainable Finance Disclosure Regulation and the Taxonomy Regulation to the current Corporate Sustainability Reporting Directive - has been enacted to redirect private capital into sustainable financing (green finance). The article first presents the European green finance rules for credit and capital market financing, which are particularly relevant for banks, and then goes on to examine the liability and sanctions for violations.
